No, The Supreme Court Isn’t Coming for Medical Marijuana Patients’ Gun Rights, Here’s Why

Headlines have been circulating this week about the Supreme Court trying to take guns away from people with medical marijuana cards.

But I’m here to set the record straight: it’s fearmongering clickbait.

Because here’s the truth—in the United States, it’s already illegal under federal law to own a gun and hold a medical cannabis license at the same time.

If you do both, you’re technically in violation of federal law, even if your state allows medical cannabis.

So what’s actually happening?

The Supreme Court is going to make a ruling to decide if this is how we want to continue to maneuver, or decide whether this law is archaic and needs to be changed so that medical marijuana users can also own a firearm.

This federal restriction comes from the Gun Control Act of 1968, which classifies anyone who uses a federally illegal substance (like cannabis) as an “unlawful user” who cannot legally possess firearms.

Since cannabis is still a Schedule I drug, that law automatically applies, even if you have a state-issued medical card and are fully compliant with local laws.

What the Supreme Court is reviewing right now is whether that restriction is constitutional.

The question isn’t whether to take rights away: it’s whether to restore rights that cannabis patients have been denied for decades.

So to be clear: no one’s coming to take away the rights that we currently have—because we don’t have them yet.

The upcoming ruling could either expand our rights or keep things exactly as they are.
